Yatouland - The birthday king since 2006
These terms govern the sale of services sold on www.yatouland.com. They also govern those sold through the Yatouland switchboard (022 341 40 00) or by email (contact@yatouland.com).
These general terms and conditions apply to all sales transactions concluded by Yatouland. Depending on the type of service sold (Yatou'birthday, Yatou' laser, Yatou'budget, Yatou'Bigday, Yatou'Paintball, …), special conditions apply.
Each client acknowledges having the capacity to enter into a contract under the conditions described in the general terms and conditions presented herein.
Each client acknowledges having read these terms before making their booking.
Therefore, validating the booking constitutes full acceptance of the general and special conditions, and unconditional acceptance of all clauses.
Clients are informed that their booking is subject to automated personal data processing.
The right of access and rectification is exercised with Yatouland.
Despite all care taken in the construction and updating of www.yatouland.com, commercial documentation, communication materials, etc., errors, inaccuracies or omissions may persist, as well as problems connecting to the website, interruption of connection, receipt or interruption of telephone calls. Yatouland declines all liability for any direct or indirect damage that may result.
Through hyperlinks, the client may be able to visit other sites; Yatouland cannot be held responsible for the content of sites to which it links and over which it has no control.
Clients accept the recording and retention of their personal data. These may be used for commercial purposes by Optimalive and their sponsors.
The prior offer consists of the information provided in commercial documentation, on the site www.yatouland.com as well as in these general terms and conditions of sale.
The services offered are described in the descriptions on each formula card (www.yatouland.com).
The description is supplemented by the confirmation email sent to the client at the time of booking validation; this supplement is set out below:
Included in all chosen services: 5 Morand syrup flavours, and all Yatouland tableware.
Invitation cards are downloadable from our website by clicking on the chosen formula card.
Yatouland opens its doors from 10:00 to 12:00 (morning), 13:00 to 15:00 (afternoon) or 16:00 to 18:00 (evening) for Yatou'Birthday, Yatou'Laser, Yatou'Budget, Yatou'bigday, Yatou'Paintball formulas.
The end of birthday parties (Yatou'Birthday, Yatou'Laser, Yatou'Budget, Yatou'Bigday, Yatou'Paintball) is set at 12:00 (morning), 15:00 (afternoon) and 18:00 (evening). At that point, activities stop, clients (and their guests) head to the exit (the client ensures this!), clearing their tables as much as possible; bins (rubbish and PET) are provided for this purpose in each birthday space.
For Lasergame, the entire group must be present 10 minutes before the session time.
For Paintball, the entire group must be present 15 minutes before the session time; for special conditions (in addition to these general terms), consult www.paintball.ch.
Any delay by the client compared to the scheduled time cannot be compensated by extending the duration of the service.
All prices are displayed in Swiss francs, VAT always included.
Upon booking validation, the rates ('birthday packages', 'additional options and activities' and 'Yatouland extra services') are firm and final.
To book, the client must complete the booking form as set out on www.yatouland.com.
For packages (Yatou'Birthday, Yatou'Laser, Yatou'Budget, Yatou'Bigday, Yatou'paintballlaser, Escape Paintball), an immediate deposit of fifty Swiss francs (CHF 50.-) or the full amount must be paid at the time of booking, via www.yatouland.com.
The remaining balance must be settled on site, before the end of the birthday party or session, in cash or by bank card (Visa, Mastercard, Maestro, Postcard, etc.), or via Twint.
Any failure to pay on the day of the event will automatically incur additional administrative and reminder fees. If payment is not made within a reasonable time, the file will be transferred to our legal department for recovery, which may incur additional charges at the client's expense.
Your booking is only validated when the form has been duly completed and the deposit or full amount has been paid; by this validation, the client acknowledges having read these general terms and conditions (which they also ticked when completing the form) and agrees to comply with them without reservation.
The client will receive an email confirming the registration of their booking without undue delay.
Yatouland reserves the right to use recovery services in the event of non-payment.
The client has the right to withdraw, modify and cancel their booking within 7 days of receiving the confirmation, which can be exercised with Yatouland's booking service:
Any modification of the booking must be the subject of a written request (email) from the client at the latest 21 days before the date of the booking.
Any cancellation must be addressed by email to Yatouland at the latest 21 days before the booking date, this being the condition for the refund of the deposit and if it is impossible to reschedule the booking to a later date; the date of the email will be used for the cancellation.
Cancellation within less than 21 days automatically entails the loss of the deposit, which will be cashed as compensation.
In the case of non-attendance or cancellation within 24 hours or less, except in cases of force majeure (illness, accident… – supporting documents required), the total amount of the booking is owed by the client to Yatouland.
In the absence of receipt of fees corresponding to the booked services, within the deadlines set out above, Yatouland reserves the right to consider the client's booking as cancelled.
Individual entry fees cannot under any circumstances be refunded.
Yatouland has the right to modify the booking date.
Yatouland's liability is not engaged in the event of loss, theft or deterioration of property deposited in the premises/spaces made available to the client.
Each visitor is responsible for any damage, direct or indirect, that they may cause during their presence in Yatouland spaces.
The client agrees to comply with the safety instructions indicated by staff, posted within the Yatouland park and set out in these general terms and conditions at points IV ('Conditions of access to Yatouland Park') and V. ('Safety instructions'), constituting the internal regulations of Yatouland Park.
Each visitor must comply with the provisions of these regulations.
Yatouland reserves the right to expel any offender, without recourse or refund of fees paid.
Minors are the responsibility of an adult supervisor even in the presence of Yatouland staff/entertainers; the supervisor must ensure that the child under their responsibility complies with the provisions of these regulations.
All children must comply with the following instructions:
Any child who does not comply with these instructions may be temporarily excluded from games after two warnings; parents will be informed. This also applies in cases of verbal abuse towards other children or staff, physical violence, failure to respect premises, vandalism, etc.
Participants confirm they have no contraindication to the practice of physical and sporting activities, activities involving bouncy castles or a change in the intensity and/or colour of lighting. If this proves to be incorrect, Yatouland disclaims all liability.
All participants acknowledge that playing in bouncy castles is an activity that presents certain risks and they accept all conditions. Yatouland cannot be held responsible for any accident arising from individual faults; in such cases, no legal action may be considered by participants or their beneficiaries.
Unless otherwise indicated by post or email to Yatouland, parents accept that Yatouland may display or broadcast photographs or audiovisual documents representing their child(ren) in its communication materials.
Legal representatives undertake not to exercise any subsequent recourse in the event of publication of these images or audiovisual documents.
Any complaint regarding fees, the booking, or the performance of the service must be addressed to Yatouland (4, Chemin de la Gravière, CHF-1227 Les Acacias or http://yatouland.com/contactez-nous).
In the event of a complaint or dispute, the parties will attempt to find an amicable solution before any other action, it being noted that this period for resolution does not interrupt the period for taking action.
Yatouland will retain, as an archive, a copy of the booking confirmation and/or any communication with the client serving as proof of the date, formula and terms of the booking, unless duly justified objection from the client.
